TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions of Service (“Terms”) govern all services provided by Brighter Homes Maintenance and Renovations Pty Ltd (“the Company”, “we”, “us”, “our”) to the Client. By accepting a quotation, making a booking, or permitting work to commence, the Client agrees to be bound by these Terms.

1. DEPOSIT AND PAYMENT TERMS
(a) A deposit of 20% of the quoted amount is required to secure all bookings. No works will be scheduled or commence until the deposit has been received.
(b) Final payment of the remaining balance is due immediately upon completion of the works, unless
otherwise agreed in writing.
(c) Payments not received within 7 days of the due date may attract a late payment fee and interest
calculated at 5% per month on the outstanding amount.
(d) The Company reserves the right to suspend or cease work if payments are not made in accordance with these Terms.

2. CANCELLATIONS AND RESCHEDULING
(a) Clients must provide a minimum of 48 hours’ notice for cancellations or rescheduling of works.
(b) Deposits are non-refundable where cancellations are made with less than 48 hours’ notice.
(c) The Company reserves the right to charge reasonable fees or recover costs for cancellations made outside these terms.

3. VARIATIONS AND ADDITIONAL WORK
(a) Any variations, additions, or changes to the original scope of works must be agreed to in writing by the Client prior to commencement of such works.
(b) The Company will provide a separate quotation for any variations, and such works will be invoiced in addition to the original contract price.
(c) The Client acknowledges that unforeseen issues, including but not limited to structural defects, hidden damage, or non-compliant prior work, may necessitate additional works and costs.

4. WARRANTIES
(a) The Company warrants that all workmanship will be carried out with due care and skill and in accordance with with industry standards.

(b) A workmanship warranty of 12 months applies to completed works, commencing from the date of
completion.

(c) This warranty does not apply to damage caused by misuse, neglect, external factors, subsequent
works by third parties, or fair wear and tear.
(d) The warranty is conditional upon full payment being received in accordance with these Terms.

5. LIABILITY AND SITE CONDITIONS
(a) The Company shall not be held liable for any pre-existing damage, structural issues, or defects
discovered during works.
(b) The Client must ensure clear site access, removal of fragile items, and a safe working environment. The company is not responsible for any delays or damage caused by inadequate site preparation.
(c) In the event of unsafe conditions, the Company reserves the right to postpone works until such hazards are rectified.
(d) The Company shall not be liable for delays caused by inclement weather, supplier delays, or other factors beyond its reasonable control.

6. PHOTOGRAPHY AND MARKETING
(a) The Client acknowledges and agrees that the Company may take before and after photographs of the works performed for the purposes of record keeping and marketing, including on websites and social media.
(b) Clients who do not wish for images of their property to be used must advise the Company in writing prior to the commencement of works.

7. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria.

8. ENTIRE AGREEMENT
These Terms, together with any written quotation or proposal provided by the Company, constitute the entire agreement between the parties. No prior communications, representations, or agreements shall have any force or effect unless expressly incorporated herein. The Client acknowledges that they have read, understood, and agree to these Terms and Conditions. Acceptance of a quotation, payment of a deposit, or allowing works to commence constitutes acceptance of these Terms in full.
